Agreement to Terms

By accessing or using the SafeBites mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

SafeBites is a food sensitivity tracking application that allows users to:

  • Log meals and food items
  • Record symptoms and their severity
  • View potential correlations between meals and symptoms
  • Scan product barcodes to identify ingredients

CRITICAL MEDICAL DISCLAIMER

SafeBites is NOT a Medical Device

SafeBites provides informational correlations and pattern recognition ONLY. It does NOT:

  • Diagnose food allergies, intolerances, or medical conditions
  • Provide medical advice, treatment recommendations, or professional healthcare guidance
  • Replace consultation with qualified healthcare providers
  • Detect or confirm allergies through testing or medical analysis
  • Guarantee accuracy of food sensitivity predictions

YOU MUST:

  • Consult with a qualified healthcare provider before making any medical decisions
  • Seek immediate medical attention for severe allergic reactions or medical emergencies
  • Verify all food safety information independently
  • Not rely solely on SafeBites for managing food allergies or medical conditions

LIABILITY DISCLAIMER: We are not liable for any health consequences, allergic reactions, or medical issues arising from your use or misuse of SafeBites. The App provides correlations and patterns based on your self-reported data only.

Eligibility

You must be at least 13 years old to use SafeBites. If you are under 18, you must have parental or guardian consent to use the App.

Account Registration

Creating an Account

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access or security breach

Account Termination by You

You may delete your account at any time through the app settings. Upon deletion:

  • Your personal data will be permanently deleted within 30 days
  • You will lose access to all data stored in the App
  • Active subscriptions will not be automatically refunded (see Subscription Terms)

Acceptable Use Policy

You agree NOT to:

  • Use the App for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the App's functionality or servers
  • Upload viruses, malware, or any harmful code
  • Scrape, copy, or harvest data from the App using automated means
  • Impersonate any person or entity
  • Use the App to harm, harass, or threaten others
  • Reverse engineer, decompile, or disassemble the App
  • Remove or modify any proprietary notices or labels
  • Use the App for any commercial purpose without our written permission

Intellectual Property Rights

Our Rights

SafeBites and all related content, features, and functionality are owned by Reece O'Connor and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only.

Your Rights

You retain ownership of the data you enter into SafeBites (meal logs, symptom reports, etc.). By using the App, you grant us a license to store, process, and display your data to provide the services described in these Terms.

Third-Party Content

Product information from Open Food Facts and other sources may be subject to third-party terms and licenses. We do not guarantee the accuracy or completeness of third-party data.

Subscription Terms

Free Trial and Paid Subscriptions

  • SafeBites offers a free tier with basic features (meal logging, symptom logging, barcode scanning, 30-day diary)
  • Premium subscriptions unlock additional features: AI-powered insights, unlimited history, data export, smart reminders, and weekly digest
  • Pricing: Premium Monthly ($4.99/month) or Premium Annual ($39.99/year)
  • Pricing and features are subject to change with 30 days' notice
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Cancellations take effect at the end of the current billing period

Payment Processing

  • All payments are processed by Apple via in-app purchases
  • Subscription management is handled through your Apple ID account settings
  • We do not store or have access to your payment information

Refunds

  • Refund requests are subject to Apple's refund policy
  • Contact Apple Support for refund inquiries
  • We do not process refunds directly

Subscription Cancellation

  • You may cancel at any time through your Apple ID account settings
  • Upon cancellation, you will retain access until the end of the current billing period
  • No partial refunds for unused portions of subscription periods

User Content

Your Responsibility

You are solely responsible for the accuracy and content of data you enter into SafeBites, including:

  • Meal descriptions and ingredients
  • Symptom reports and severity ratings
  • Photos uploaded to the App

Content Guidelines

Do not upload content that:

  • Contains personal information of others without consent
  • Is offensive, defamatory, or violates others' rights
  • Infringes on intellectual property rights
  • Contains malicious code or harmful material

Our Rights

We reserve the right to:

  • Review and remove content that violates these Terms
  • Suspend or terminate accounts for violations
  • Report illegal activity to authorities

Data Synchronization and Offline Use

Local-First Architecture

  • SafeBites stores meal and symptom data locally on your device for offline access
  • The app functions fully offline for meal logging and symptom tracking
  • Data automatically syncs to our servers when an internet connection is available

Data Conflicts

  • In case of data conflicts between local and server data, the most recent update (last-write-wins) will be preserved
  • We recommend syncing regularly to avoid potential data conflicts

Your Responsibilities

  • Ensure your device has adequate storage space for local data
  • Do not uninstall the app or clear app data before data has synced, or you may lose unsynced entries
  • Keep the app updated to ensure sync functionality works properly

Privacy and Data Protection

Your use of SafeBites is also governed by our Privacy Policy, available at https://safebites.io/privacy. By using the App, you consent to the data practices described in the Privacy Policy.

Disclaimer of Warranties

SafeBites is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

  • Accuracy: We do not warrant that data from Open Food Facts or other sources is accurate, complete, or current
  • Availability: We do not guarantee uninterrupted or error-free operation
  • Fitness for Purpose: We do not warrant that the App will meet your specific requirements
  • Security: While we implement security measures, we cannot guarantee absolute security

YOU USE SAFEBITES AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We (Reece O'Connor, SafeBites, and our affiliates, officers, employees, and agents) shall NOT be liable for:

  • Health Consequences: Any injury, allergic reaction, illness, or health issue arising from your use of SafeBites
  • Indirect Damages: Lost profits, data loss, business interruption, or consequential damages
  • Inaccurate Information: Errors or omissions in product data, ingredient lists, or correlations
  • Third-Party Services: Actions or omissions of third-party service providers (Supabase, RevenueCat, etc.)
  • Force Majeure: Events beyond our reasonable control

MAXIMUM LIABILITY: Our total liability to you for all claims related to SafeBites shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100 USD, whichever is less.

Some jurisdictions do not allow limitation of liability for personal injury or incidental/consequential damages, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless SafeBites, Reece O'Connor, and our affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your content or data entered into the App

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date
  • Sending an in-app notification or email (for significant changes)

Your continued use of SafeBites after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and delete your account.

Modifications to the App

We reserve the right to:

  • Modify, suspend, or discontinue any feature of SafeBites at any time
  • Change subscription pricing with 30 days' notice
  • Update the App to fix bugs, improve performance, or add features

We are not liable for any modifications, suspensions, or discontinuations of the App or its features.

Termination

Termination by Us

We may suspend or terminate your access to SafeBites immediately, without prior notice or liability, if:

  • You breach these Terms
  • Your use poses a security risk or violates laws
  • Your account has been inactive for an extended period
  • We discontinue the service

Effect of Termination

Upon termination:

  • Your right to use the App ceases immediately
  • Your data may be deleted according to our data retention policies
  • Provisions that should survive termination will remain in effect (disclaimers, limitations of liability, indemnification, dispute resolution)

Dispute Resolution

Governing Law

These Terms are governed by the laws of Ireland, without regard to conflict of law principles.

Informal Resolution

Before filing a claim, you agree to contact us at reeceo71@gmail.com to attempt informal resolution.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the laws of Ireland, except where prohibited by law.

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.

Exceptions

You may bring claims in small claims court if they qualify, and either party may seek injunctive relief in court for intellectual property or confidentiality violations.

Geographic Restrictions

SafeBites is controlled and operated from Ireland. We make no representation that the App is appropriate or available for use outside Ireland. If you access SafeBites from other locations, you are responsible for compliance with local laws.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SafeBites regarding your use of the App and supersede all prior agreements and understandings.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign or transfer these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Third-Party Links and Services

SafeBites may contain links to third-party websites or services (e.g., Open Food Facts). We are not responsible for the content, privacy practices, or terms of third-party services. Your use of third-party services is at your own risk.

Feedback

If you provide feedback, suggestions, or ideas about SafeBites, you grant us the right to use that feedback without compensation or obligation to you.

Emergency Situations

IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, INCLUDING SEVERE ALLERGIC REACTIONS:

  • Call emergency services immediately (999 in Ireland, 911 in the US, or your local emergency number)
  • Do NOT rely on SafeBites for emergency medical guidance
  • Seek immediate medical attention

Acknowledgment

By using SafeBites, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
